What Is the Time Limit for Disclaiming an Inheritance in Türkiye?

Last updated: 19 July 2026

How Long Do Heirs Have to Disclaim an Inheritance?

Under the Turkish Civil Code, the general period for disclaiming an inheritance is three months. The starting date is not identical for every heir. Legal heirs generally calculate the period from the date they learn of the death, unless they prove that they learned of their heirship later. Heirs appointed by a will or inheritance contract generally calculate the period from official notification of the disposition.

Heirs seeking an Antalya lawyer or a Serik lawyer should identify the precise date of knowledge and avoid disposing of estate assets before deciding. Certain acts may be treated as acceptance and can prevent a later disclaimer.

Where Is the Disclaimer Made?

The heir submits an unconditional declaration to the civil court of peace. The declaration may be made orally before the court or in writing and is recorded in the special register. It must clearly state that the inheritance is disclaimed without conditions or reservations.

A statement sent only to another heir, creditor, bank or notary is not necessarily a valid judicial disclaimer. Representation through a lawyer requires appropriate authority.

Starting Date by Heir Type

Heir type or situation General starting point Important qualification
Legal heir Date of learning of the death The heir may prove that heirship was learned later.
Appointed heir Official notification of the testamentary disposition The opening and notification record should be preserved.
Estate inventory procedure According to the statutory notification following inventory Special procedural rules may affect the period.
Minor or protected person Calculated through the legal-representation framework Guardianship authority approval and conflict representation may be required.
Later-discovered heirship Date the person actually learns of being an heir The later knowledge must be proved.

Documents Commonly Prepared

The application generally identifies the deceased, date of death, applicant’s relationship, knowledge date and declaration of disclaimer. Identity documents, death information, civil-registry records and any certificate of inheritance may be attached. Appointed heirs should include the will or official notification information.

If the heir is abroad, a properly legalised power of attorney and certified translation may be needed. The declaration must still reach the competent court within the period.

Can the Period Be Extended?

The civil court of peace may extend the period or grant a new period where important reasons exist. This is an exceptional remedy and should not be treated as an automatic extension. Illness, lack of knowledge or another obstacle must be explained and documented.

An application for additional time should be made promptly. Waiting until creditors start enforcement may weaken the argument that the delay resulted from an unavoidable reason.

Acts That May Amount to Acceptance

An heir who interferes with estate affairs beyond necessary preservation or management, conceals estate property or appropriates assets may lose the right to disclaim. Selling a vehicle, withdrawing money, transferring property, dividing valuables or paying personal expenses from estate funds may be legally significant.

Protective acts such as securing a home, arranging a funeral or obtaining information do not always mean acceptance. The purpose and scope of the act must be assessed. Keep estate property separate and preserve receipts.

What Happens After a Valid Disclaimer?

An heir who validly disclaims is treated, for the relevant succession consequences, as though they were not an heir. The share passes according to the statutory or testamentary succession rules. If all closest legal heirs disclaim, the estate may be liquidated under the official-liquidation provisions rather than passing automatically in the ordinary way.

A parent’s disclaimer may cause descendants to become heirs. Each person’s status and period must therefore be examined separately. A family cannot assume that one declaration automatically covers everyone.

Deemed Disclaimer Because of Insolvency

If the deceased’s insolvency was officially determined or clearly evident at the time of death, the inheritance is deemed disclaimed under Article 605/2. This is different from filing an ordinary disclaimer within three months. Whether insolvency was “clearly evident” is a fact-sensitive legal question.

Debt exceeding assets is important, but the evidence should show the estate’s condition at death. Enforcement files, unpaid debts, absence of assets, tax records and creditor information may be relevant.

Disclaimer and Creditors

A disclaimer does not automatically eliminate every issue involving the heir’s own creditors or prior transfers from the deceased. The Code contains rules protecting creditors where a solvent estate was transferred away or where an heir disclaims to prejudice personal creditors. Fraudulent transactions may be challenged.

Tax, Bank and Land-Registry Consequences

After a valid disclaimer, the court record should be used when banks, land registries, tax offices and enforcement authorities assess heirship. A previously obtained certificate of inheritance may need correction to reflect the changed legal position.

Frequently Asked Questions

Is the disclaimer period always three months from death?

Three months is the general period, but the start depends on when the legal heir learned of the death or when an appointed heir was formally notified.

Can I disclaim before obtaining a certificate of inheritance?

Yes. A certificate is not always required first, but the court must be able to identify the deceased and the applicant’s heirship.

Can I disclaim only the debts and keep the assets?

No. Disclaimer concerns the inheritance as a whole and cannot be made conditionally or partially.

Does paying funeral expenses mean acceptance?

Not necessarily. Necessary funeral and preservation acts are assessed differently from taking ownership or disposing of estate assets.

Can a disclaimer be withdrawn?

A valid disclaimer is generally irrevocable. Defects in will, mistake or other exceptional grounds require specific legal assessment.

If I disclaim, do my children become heirs?

They may, depending on the succession line and circumstances. Their status and any required representation or court approval must be reviewed separately.

What is deemed disclaimer?

It is the statutory consequence where the deceased’s insolvency was officially determined or clearly evident at death, subject to proof and legal assessment.

Acting Before Estate Transactions Create Acceptance Risk

The three-month period must be calculated for each heir, and estate assets should not be used before the legal options are reviewed.
