Documents Required for a Title Deed Cancellation and Registration Action

Last updated: 19 July 2026

When Is a Title Deed Cancellation and Registration Action Filed?

A title deed cancellation and registration action seeks cancellation of an incorrect or unlawful registered ownership entry and registration of the person claiming the true right. The legal ground may involve an invalid registration, forged signature or power of attorney, incapacity, fraud, abuse of representation authority, collusive transfer by a deceased person, a fiduciary transaction, an invalid contract or cadastral issues.

People seeking an Antalya lawyer or a Serik lawyer should not proceed only with the statement that “the property was transferred unfairly.” The exact legal ground determines the defendants, evidence, interim measures and applicable limitation or strict time-bar rules.

Current and Historical Land-Registry Records

The first records to obtain are the current title entry, historical transfer chain, official transaction documents and journal information. These show the current registered owner, share, transfer reason, date, declared price and encumbrances.

If the property was transferred again, the current owner and other relevant parties may need to be included. The Turkish Civil Code protects certain good-faith third parties who rely on the land registry. A person who knew or should have known of the invalid registration may not receive the same protection.

Documents by Legal Ground

Legal ground Important documents Fact to be proved
Incapacity Hospital files, prescriptions, medical reports and guardianship records near the transaction date Lack of discernment when the transfer was made
Collusive transfer by the deceased Official sale record, bank records, certificate of inheritance, financial capacity and witnesses A concealed intention to deprive heirs rather than a genuine sale
Forged signature or power of attorney Original documents, notarial archive, signature samples and criminal-file records The registered transaction did not reflect the owner’s will
Abuse of authority Power of attorney, sale price, bank transfers and relationship between representative and buyer The representative acted against instructions and the principal’s interests
Fiduciary transaction Written fiduciary agreement, payments, messages and request for re-transfer The property was transferred temporarily for a defined purpose
Fraud or invalid agreement Contracts, communications, payment and possession records Invalid consent, form or legal basis

Which Court Is Competent?

The civil court of first instance generally hears title deed cancellation and registration actions. Because the action concerns a right in immovable property, the court where the property is located has exclusive territorial jurisdiction. Cadastral objections or claims based on pre-cadastral events may fall under special jurisdiction and time rules.

Where several properties are located in different districts, territorial jurisdiction and joinder should be examined property by property.

Documents Showing the Claimant’s Standing

The claimant must show the legal basis for requesting registration. An heir may need a certificate of inheritance; a contractual claimant needs the agreement and payment records; a former owner relies on the historical title and transaction records. Company claimants require current registration and representation documents.

In an undivided estate, whether one heir may bring the action alone, whether an estate representative is required and whether the claim is divisible must be assessed.

Why Request an Interim Injunction?

Further sale or creation of new rights during litigation may make recovery difficult. The claimant may request an interim injunction to be annotated in the land registry. The application should present approximate proof, the risk of serious difficulty and a proportionate requested restriction.

The court may require security. An injunction protects the disputed situation during litigation but does not mean that the claimant has already won.

Bank and Payment Records

The relationship between the declared title price and the actual payment may be important. Bank transfers, withdrawals, loans and the parties’ financial capacity can show whether a sale was genuine. Cash-payment allegations should be supported by receipts, witnesses and surrounding circumstances.

A very low price does not by itself invalidate the transfer, but it may support a broader allegation of collusion, incapacity or abuse of authority.

Medical Evidence in Incapacity Claims

The legally relevant time is the date of the title transaction. A general medical report prepared years later may be insufficient. Hospital, neurology, psychiatry, medication and family-doctor records close to the transaction date should be identified.

The court may request retrospective assessment by forensic medicine or another expert. Only records relevant to capacity should be requested because health information is sensitive personal data.

Witnesses and Digital Evidence

Witnesses may explain the purpose of the transaction, payment, the deceased person’s statements, the parties’ relationship or possession after transfer. Direct observation should be distinguished from information heard later from a party.

Messages, emails and recordings must be obtained lawfully and preserved in context. See how to prepare evidence for a legal dispute.

Is There a Single Time Limit?

No single period applies to every title deed cancellation action. Invalid registration, fraud, mistake, fiduciary transactions, cadastral claims, contractual rights, pre-emption and inheritance-based grounds may be subject to different limitation periods or strict time bars.

The fact that the requested remedy is “title cancellation and registration” does not by itself determine whether the action is time-barred. The legal cause and date of knowledge or transaction must be analysed.

What Can the Court Decide?

If the action is accepted, the court may cancel the existing registration entirely or for a share and order registration in the claimant’s name. If the property has passed to a protected good-faith third party and restoration is impossible, compensation or state liability for maintenance of the land registry may become relevant depending on the case.

The final decision must satisfy registration and enforcement requirements before the land-registry office changes the record.

Frequently Asked Questions

Is the original title deed certificate required?

No. The current and historical official register is decisive. An old certificate may be useful but is not the complete record.

Does filing the action automatically prevent another sale?

No. An interim injunction should be requested and granted to restrict further transactions.

Does an under-declared price automatically prove the case?

No. It may support another legal ground but must be assessed with the full evidence.

Does an heir need a certificate of inheritance?

Generally yes, to prove heirship and the apparent share.

Can an action be filed after the property was sold again?

Yes, but the current owner’s good faith, the transfer chain and alternative compensation claims must be examined.

Is mandatory mediation required before every title cancellation action?

A pure action concerning a right in rem is not automatically treated like lease or dissolution-of-co-ownership disputes. Combined contractual or monetary claims require separate analysis.

How long does the case take?

Duration depends on parties, service, medical and bank records, experts, witnesses and the number of transfers. A fixed duration cannot be promised.
