How to Prepare Evidence for a Legal Dispute

Last updated: 19 July 2026

How Should Evidence Be Prepared for a Legal Dispute?

The fact that an allegation is true does not mean it will automatically be proven before a court or public authority. The relevant facts must be stated clearly, each item of evidence must be connected to a specific fact and the original integrity of the records must be preserved. Contracts, bank records, messages, emails, witnesses, photographs, official documents and expert examinations may each have a different evidential function.

Before consulting an Antalya lawyer or a Serik lawyer, arranging the evidence in an organised form helps identify the strong and weak parts of the file. It also prevents important records from being deleted, altered or submitted after a procedural deadline.

Start by Identifying the Facts That Must Be Proved

Evidence preparation should not begin by placing random documents in a folder. First write the events in chronological order. Identify the contract, obligation, breach, payment, loss, notice and response. Then write next to each event the record that may prove it.

For example, a claim that a debt was not paid may require the contract, invoice, delivery record, bank statement and payment request. A claim of defective service may involve the contract, photographs, messages, minutes and an expert examination. The broader litigation plan should also be reviewed in what to consider before filing a lawsuit.

Evidence Types and Preparation Methods

Evidence type How to prepare it Key risk
Written documents Keep the original, complete copy and attachments in date order. Missing pages or unsigned versions may change the interpretation.
Bank and financial records Preserve transfers, account statements, invoices and receipts together. The payer, date, amount and payment description must be visible.
Messages and emails Preserve the full conversation, parties, dates and original account. Cropped screenshots may remove context or raise authenticity disputes.
Photographs and videos Keep the original file, date information and available metadata. Editing or re-saving may affect integrity and metadata.
Witness evidence Record which event each witness personally saw or heard. Hearsay should be distinguished from direct observation.
Official records Identify the authority, file number, date and requested record. The correct institution and legal request method must be determined.
Expert evidence Preserve the object, technical data, damage and inspection conditions. Repair, disposal or use may destroy the condition to be examined.

Preserve Originals and Document Integrity

Original contracts, promissory notes, receipts, minutes and signed forms should be kept in a safe place. Do not make handwritten notes on them, remove staples, separate pages or alter seals and physical features. Where a copy is made, include the reverse side, attachments and signature pages.

If a document has several versions, preserve all of them and record where each version came from. Do not replace an older file with a revised version. Version history may be important in contract, employment and digital-content disputes.

Preparing Messages, Emails and Social Media Records

A screenshot should show the name or account, date, time and enough of the conversation to establish context. Keep the original device or account active and, where possible, export the full conversation. For email, retain headers, attachments and the original electronic message rather than relying only on a printed page.

Public social media content may be preserved with the URL, account name, access date and full-page capture. Content can later be deleted or changed. In urgent cases, a notarial record, expert preservation or court-based determination of evidence may be considered.

Evidence Must Be Obtained Lawfully

Do not access another person’s phone, email, cloud account, banking profile or private premises without authority. Do not install tracking software, impersonate someone online or encourage unlawful recording. Evidence obtained by violating privacy, communication secrecy or personal data rules may be rejected and may expose the person collecting it to separate liability.

The lawfulness of an audio or video recording depends on the specific circumstances. The belief that “I need proof” does not automatically make secret recording lawful. Before creating such a record, the necessity, proportionality and lawful alternatives should be evaluated.

How Should Witnesses Be Identified?

Write the witness’s full name, current address and the specific event personally observed. A witness should not be coached to repeat a prepared story. It is sufficient to identify what the person directly saw, heard or did.

A person who knows the event only because one party later described it is not equivalent to an eyewitness. The relationship between the witness and the parties may also be considered when the court assesses credibility.

Obtaining Records from Institutions

Some evidence is held by banks, hospitals, employers, telecommunications companies, public authorities, land registry offices or social security institutions. Note the institution, account or file number, date range and the reason the record is relevant. A court may request records that a party cannot lawfully obtain directly.

Personal data protection and confidentiality rules may limit direct access. Do not attempt to obtain another person’s protected records through false statements or unauthorised access.

When Should Determination of Evidence Be Considered?

If evidence may disappear or become difficult to examine before the lawsuit, a determination of evidence may be requested under the applicable procedural rules. Examples may include construction defects that will be repaired, perishable goods, damage that must be removed for safety, changing website content or machinery that must resume operation.

The request should explain what will be examined, which future claim it relates to and why waiting would create a risk. Determination of evidence does not by itself decide the merits of the dispute.

Create an Evidence Index

Number the documents and prepare a short index. Each line should include the document date, description, source and the fact it supports. Long email chains or account statements may be divided into clearly labelled sections without altering the original record.

A separate working copy may contain highlights and notes, while the original remains untouched. The same numbering should be used in the chronology and any draft petition.

Submission Deadlines and Procedural Rules

Evidence should be submitted at the stage and within the time required by the applicable procedure. Late evidence may be rejected unless a lawful exception applies. A party should not wait for the hearing to mention documents already in their possession.

After the statement of claim is filed, the procedure and evidence stages are explained in what happens after a statement of claim is filed. Hearing preparation is addressed in how to prepare for a court hearing.

Frequently Asked Questions

Is a screenshot accepted as evidence?

It may be considered, but authenticity, completeness, lawful acquisition and connection with the relevant person must be assessed. Preserve the original account and device.

Should I give the original document to the other party?

No. Originals should be kept securely and submitted only through the lawful procedure when required. Working copies can be prepared for review.

Can secretly recorded audio be used?

The answer depends on the facts and the lawfulness of the recording. Secret recording may violate criminal, privacy and personal data rules.

What if the evidence is held by a bank or public authority?

Identify the institution, record and date range. The court or competent authority may request records that cannot be obtained directly.

Can deleted digital content be recovered?

Sometimes, but recovery is not guaranteed. Preserve devices, backups, links and metadata promptly and avoid actions that overwrite data.

How many witnesses should be listed?

Quality is more important than number. Each witness should have direct knowledge of a specific disputed fact.

Can I edit a photograph to make the issue clearer?

Do not alter the original. A labelled working copy may be created for explanation, but the untouched original must be preserved and the edit disclosed.
