What Happens After a Statement of Claim Is Filed?

Last updated: 19 July 2026

What Does the Court Do After the Statement of Claim Is Submitted?

After a statement of claim is registered, the court file receives a case number and is assigned to the competent judicial unit. Filing does not mean that the merits have already been accepted. The court first reviews formal requirements, fees, procedural conditions and service arrangements before the dispute proceeds through the petition and evidence stages.

People working with an Antalya lawyer or a Serik lawyer should monitor the file from the first day. A request to complete a missing fee, provide an address or submit a document may be subject to a definite court period. Failure to comply can affect the continuation of the action.

The File Receives a Court and Case Number

The filing receipt and UYAP record identify the court, case number, filing date and parties. These details should be used in every later petition, payment and correspondence. The claimant should verify that the defendant, case type, value and requested relief were recorded correctly.

The filing date may be important for limitation periods and other substantive or procedural consequences. The receipt, electronic confirmation and payment records should therefore be preserved.

The Court Conducts Initial Formal Checks

The court examines whether the petition contains the required information, whether the case fee and expense advance were paid and whether procedural conditions can be assessed at that stage. If a correctable deficiency exists, the court may grant a period to complete it and state the consequence of non-compliance.

Some matters, such as jurisdiction, legal capacity, mandatory mediation and pending identical proceedings, may be considered as procedural conditions. Other objections may need to be raised by the defendant within the response.

The Statement of Claim Is Served on the Defendant

Once the file is ready for service, the statement of claim and relevant attachments are sent to the defendant. Valid service is essential because it starts the response period. Under the written procedure, the defendant generally has two weeks from service to submit a response.

If preparation within two weeks is very difficult or impossible, the defendant may request an additional period within the original response period. The court may grant one additional period of up to one month, beginning after the original period ends. Special procedures and statutes may provide different rules.

What If the Defendant Does Not Respond?

Failure to submit a response does not mean that the claimant automatically wins. The defendant is generally deemed to deny the facts asserted in the statement of claim, but may lose the ability to raise certain procedural objections, factual defences or evidence later. The claimant must still prove the facts on which the claim is based.

The Exchange of Petitions and Preliminary Examination

In the written procedure, the defendant’s response may be followed by the claimant’s reply and the defendant’s second response, subject to the statutory periods. In the simplified procedure, the exchange is more limited. The applicable procedure depends on the court and the dispute.

After the petition stage, the court conducts preliminary examination. It reviews procedural conditions and objections, identifies the points of agreement and dispute, encourages settlement or mediation where appropriate and plans the evidence stage. Parties are invited to the preliminary examination hearing with warnings about attendance and evidence.

Main Stages of Civil Proceedings

Stage Main purpose What parties should monitor
Registration and formal review Create the file and correct initial deficiencies Case number, fees, addresses and court orders
Service and petition exchange Allow both parties to state claims and defences Service dates and response periods
Preliminary examination Define disputed issues and procedural framework Settlement, objections and evidence warnings
Investigation Collect and examine evidence Witnesses, experts, inspection and institutional records
Oral proceedings Give final explanations before judgment Final submissions and hearing minutes
Judgment and remedies Resolve the dispute and review the decision Reasoned judgment, service and appeal deadline

What Happens During the Investigation Stage?

The court collects and evaluates the evidence identified in time. It may request records from public institutions, banks, hospitals or employers; hear witnesses; appoint an expert; conduct an inspection or order another technical examination. Parties must comply with definite periods for advances, addresses and explanations.

An expert report should be reviewed immediately. Objections must identify incomplete examination, factual error, inconsistency or a matter outside the expert’s technical competence. A general statement that the report is “unacceptable” may not be sufficient.

How Should Parties Prepare for Hearings?

Before each hearing, read the previous minutes and interim orders. Prepare the documents due at that hearing, verify whether witnesses or experts will be heard and list the points that need to be recorded. The detailed checklist is available in how to prepare for a court hearing.

Statements at the hearing should remain connected to the disputed issues. A hearing is not the place to introduce every fact again without regard to procedural limits.

Does the Process End When the Court Announces a Decision?

Not necessarily. The court may announce a short decision and prepare the reasoned judgment later. The reasoned decision must be served according to the applicable procedure before many appeal periods begin. The date on which a decision appears in UYAP is not automatically the date of legal service.

The judgment may be open to appeal before a regional court of appeal and, where legally permitted, cassation before the Court of Cassation. Guidance is available in how to file an appeal in Türkiye and how cassation review works.

How Can the File Be Followed Through UYAP?

Parties can use the UYAP Citizen Portal to view file cover details, procedural history, documents, hearing information and available decisions. The portal is a useful control tool, but it does not replace official service and legal deadline calculation.

The digital tracking process is explained in how to check a court case on e-Government and UYAP.

Frequently Asked Questions

Is the first hearing scheduled immediately after filing?

Not always. Service, response periods, completion of deficiencies and the court’s workload affect when the preliminary examination hearing is scheduled.

Does the claimant automatically win if the defendant does not respond?

No. The claimant must still prove the material facts. The defendant may, however, lose important procedural opportunities.

What should I do if the court grants time to submit a missing document?

Read whether the period is definite, complete the exact act requested and preserve proof of timely submission.

Must every expert report be challenged?

No. An objection should be filed where there is a technical, factual or methodological problem. The deadline and the report’s effect should be reviewed.

Can a document exist in the physical file but not yet appear in UYAP?

Yes. Scanning, approval and system processing may create timing differences. The judicial unit should be contacted when a critical document is missing.

When can the court’s decision be appealed?

The applicable remedy and period depend on whether the decision is final, appealable and duly served. Special statutes may provide different rules.

Can the parties settle after the lawsuit has begun?

Yes. Settlement, mediation and procedural settlement may remain possible, subject to the nature of the right and correct documentation.
