How Can Legal Deadlines Be Tracked Safely?
One of the most common causes of loss of rights is an incorrectly calculated filing, response or objection deadline. The result may change depending on what starts the period, whether it is stated in days, weeks or months, whether service was physical or electronic and whether the final day falls on an official holiday. Writing one date in a telephone calendar is not a complete deadline-control system.
People working with an Antalya lawyer or a Serik lawyer should record every legal date together with its source document, service method and file number. The calculated last day should be supported by a separate internal completion date several days earlier.
First Identify the Type of Period
A statutory procedural period, a court-ordered period, a contractual period, a limitation period and a strict time bar are not the same. A statutory period is set directly by law. A court may grant a definite or extendable period for a procedural act. A contract may contain separate notice, payment or termination periods.
A limitation period may allow the opposing party to resist enforcement of a claim, while a strict time bar may extinguish the right or procedural opportunity itself. The correct legal character must be identified before calculation begins.
Identify the Triggering Event
A period may begin with service, pronouncement of a decision, knowledge of an event, occurrence of damage, termination of a contract, maturity of a debt or another legally defined event. Under Turkish civil procedure, many periods begin upon service, while some begin when the decision is pronounced or when a special statute provides otherwise.
If an official notification has been received, preserve the envelope, service certificate and attachments. For the initial review, see what to do when you receive a legal notification.
Legal Deadline Tracking Table
| Field | Information to record | Verification source |
|---|---|---|
| File | Court, enforcement office or authority and file number | Official document and UYAP |
| Required act | Response, objection, payment, appeal or evidence submission | Document heading and applicable legislation |
| Trigger | Service, pronouncement, knowledge or event date | Envelope, UETS record, minutes or decision |
| Period type | Days, weeks, months or years; statutory or court-ordered | Law, regulation or interim court order |
| Last day | Calculated final date and relevant submission time | Holiday calendar, court hours and electronic system rules |
| Internal date | Earlier date by which the work will be completed | Calendar reminders and responsible person |
| Proof of completion | Receipt, electronic confirmation or filing number | UYAP record, stamped copy or payment receipt |
Periods Expressed in Days
For many procedural periods expressed in days, the day on which service or the triggering event occurs is not counted and calculation begins on the following day. However, a special law may provide another rule. The period runs through calendar days unless the legislation specifically refers to working days.
Do not remove weekends from the calculation merely because courts are closed. Weekends and holidays generally remain within the running period; their relevance arises when the final day falls on an official holiday.
Periods Expressed in Weeks, Months or Years
A period expressed in weeks normally ends on the corresponding day of the final week. A period expressed in months or years ends on the corresponding calendar day. If the final month does not contain a corresponding day, the last day of that month may become relevant under the applicable procedural rule.
Adding a fixed number of days to a monthly deadline may produce the wrong result. Use the legal unit stated in the law or court order.
If the Final Day Falls on an Official Holiday
Under the general civil procedural rule, if the final day falls on an official holiday, the period ends at the close of the working day following the holiday. Special legislation and electronic filing provisions should still be checked.
Do not plan to file at the last minute. Technical failure, missing electronic signature, payment error or an incomplete attachment may prevent completion even where the portal remains accessible.
Electronic Notification and the Five-Day Rule
An electronic notification is legally deemed served at the end of the fifth day following the date it reaches the recipient’s UETS address. This means the date the message appears in the inbox and the legally effective service date are not identical.
Record both dates. The procedural period is then calculated from the legally effective service date according to the applicable law. Opening the message early does not normally shorten the statutory five-day deeming period, while never opening it does not prevent service.
Physical Service Records
Keep the complete envelope and inspect who received the document, where it was delivered and which procedure was used. Service to a household member, employee, neighbourhood headman or registered address may be valid under specific conditions.
If service appears irregular, record the actual date on which the document was learned and obtain address or travel records that may support the claim. Irregular service issues often require prompt procedural action.
Court-Ordered Definite Periods
A court may grant a definite period for paying an expense, submitting a document, identifying evidence or completing another procedural act. The order should state the act required and, where applicable, the consequence of non-compliance. Missing a definite period may prevent the act from being performed later.
Read the hearing minutes and interim decision itself. A verbal summary from another person or an automated message may omit an important condition.
Judicial Recess and Special Statutes
The judicial recess does not suspend every legal period. Turkish procedural law contains rules for matters handled during the recess and for the extension of certain periods, while enforcement, criminal, administrative and special proceedings may follow different provisions.
Do not assume that a summer period, public-sector closure or holiday automatically extends a deadline. The exact procedure and statute must be checked.
Use UYAP as a Control Tool, Not the Only Source
The UYAP Citizen Portal allows parties to view ongoing and closed court and enforcement files, procedural events and available documents, subject to their access method. It is useful for confirming that a document was uploaded or that a filing appears in the file.
UYAP should not replace the official service record or the applicable law. A document may appear in the file before or after formal service, and visibility alone does not always start the procedural period.
Create a Double-Control System
- Record the deadline in a central table.
- Attach the source document or UETS record.
- Calculate the final day independently twice.
- Set reminders several days and one day before the internal date.
- Assign one responsible person.
- Complete the filing before the statutory final day.
- Save the electronic receipt, stamped copy or filing number.
- Check the official file after submission.
What If a Deadline Has Been Missed?
Act immediately. Depending on the procedure and reason, reinstatement, objection based on irregular service, delayed objection or another exceptional remedy may be available. These remedies have strict conditions and often very short periods beginning when the obstacle is removed or the missed act is learned.
Do not assume that illness, travel, workload or lack of knowledge automatically restores the period. Documents proving the obstacle and the date it ended should be collected.
Frequently Asked Questions
Are legal deadlines counted in working days?
Usually not. Many periods run in calendar days unless the legislation expressly states working days. The final-day holiday rule is a separate issue.
Is the day of service counted?
For many procedural periods it is not counted, and the calculation begins the following day. Special statutes may provide otherwise.
What happens if the last day is Sunday?
Under the general civil procedural rule, the period ends at the close of the next working day. The specific procedure should still be verified.
Does seeing a document in UYAP start the deadline?
Not automatically in every case. The legally relevant service, pronouncement or knowledge rule must be identified.
When does an electronic notification become effective?
At the end of the fifth day following the date it reaches the UETS electronic notification address.
Can a court extend a statutory deadline?
A court cannot freely extend every statutory period. Court-granted periods and statutory periods follow different rules.
Can a missed deadline be restored?
Only where the relevant law provides an exceptional remedy and its strict conditions are satisfied. Immediate action and proof of the obstacle are essential.
