What Remedies Are Available Against Attachment Measures?

Last updated: 19 July 2026

How Is the Correct Remedy Against an Attachment Determined?

An attachment may affect bank accounts, salary, movable property, vehicles, immovable property or receivables held by third parties. The correct legal response depends on who owns the asset, whether the property is legally exempt, whether the enforcement officer acted contrary to law and when the affected person learned of the measure.

Debtors and third parties consulting an Antalya lawyer or a Serik lawyer should obtain the attachment report, enforcement-file history, service records and ownership documents immediately. A generic “objection to attachment” may be ineffective if the law requires a complaint, third-party ownership claim or separate court action.

Complaint Against an Enforcement Officer’s Act

Acts and omissions of the enforcement office that are contrary to law or inappropriate may be challenged before the enforcement court through the complaint procedure. The general complaint period is seven days from learning of the act. Some complaints involving failure to perform a legal duty or public-order violations may not be subject to the ordinary period.

The complaint petition should identify the exact act, learning date, legal error and requested correction. Filing a complaint does not automatically stay every sale or enforcement step; suspension should be requested where necessary.

Property and Rights Exempt from Attachment

The Enforcement and Bankruptcy Law protects specified assets and income wholly or partly. Necessary household items, professional tools under certain conditions, parts of wages and certain social payments may receive protection. The exemption is fact-sensitive and should not be expressed as a blanket rule that “a home, salary or bank account can never be attached.”

Main Remedies

Problem Possible remedy Key evidence
Unlawful enforcement-office act Complaint to the enforcement court File history, attachment report and learning date
Legally exempt asset or income Exemption complaint Use, source of funds and personal or family circumstances
Asset belongs to a third party Third-party ownership claim and possible action Invoice, bank payment, registration and possession records
Attachment exceeds the debt Complaint concerning excessive attachment Current file balance and asset values
No debt exists Negative declaratory action or restitution action Payment, contract, release and other debt evidence
Sale-stage defect Complaint, valuation challenge or auction remedy Valuation, notice, auction conditions and sale record

What Is Excessive Attachment?

Attachment should be proportionate to the file debt, interest and enforcement costs. Attaching assets of a value clearly far beyond what is reasonably necessary may create an excessive-attachment complaint. The debtor should present the current file balance and reliable asset values and may propose a less restrictive asset.

The existence of several attached assets does not automatically prove unlawfulness. Liquidity, prior-ranking rights, mortgages and realistic sale value are considered.

If Property Belonging to a Third Party Is Attached

A person who claims ownership of attached property may use the third-party claim procedure. The timing and route depend on whether the property was in the debtor’s possession, a third party’s possession or shared premises. Invoices, registration records, bank payments, insurance, delivery and possession history may be relevant.

An invoice alone is not always conclusive. The court examines whether the transaction is genuine and whether the third party actually acquired and used the property.

Salary and Bank Account Attachment

A portion of wages may be attached, subject to statutory minimums, priority rules and special protections. Maintenance claims and certain public receivables may be treated differently. Employers must comply with the enforcement office’s notice and make the required deductions.

For bank accounts, the legal source of the money matters. Social benefits, protected payments or a salary deposit may retain statutory protection, but mixed accounts and accumulated balances can create disputes. The account statement and payment description should be presented promptly.

The “Suitable Home” Exemption

A debtor may claim exemption for a home suitable for the debtor’s and family’s condition under the statutory rule. The assessment considers family size, social circumstances, location, value and whether a less valuable suitable residence could be obtained. Merely having no second home does not automatically resolve the claim.

The complaint is generally time-sensitive from learning of the attachment. Title records, residence, household and valuation evidence should be prepared.

Negative Declaratory and Restitution Actions

A debtor who claims that no debt exists may file a negative declaratory action under the statutory conditions. Filing the action does not automatically stop enforcement. Interim protection may require security and is limited by the stage of the file.

If money has already been collected under enforcement, a restitution action may be available within the applicable period. These actions concern the underlying debt, not merely the formal lawfulness of the attachment act.

Rights at the Sale Stage

Valuation, sale notice, electronic-auction conditions and statutory timing should be monitored. A valuation may be challenged through the relevant complaint procedure. After the auction, annulment of the auction is available only to authorised persons and under specific grounds and periods.

Frequently Asked Questions

Can all household items be attached?

No. Necessary household items may be protected, while duplicate, luxury or non-essential property may be treated differently.

Can attachment occur when the debtor is not at home?

It may, if the statutory entry, presence and reporting conditions are followed. The circumstances should be checked from the attachment report.

Is a third party’s invoice enough to remove the attachment?

Not always. Ownership, payment, delivery, possession and the reality of the transaction are assessed together.

Can all money in a bank account be attached?

The source of funds and statutory protections matter. Protected social or salary payments may require a prompt exemption claim.

Does filing a complaint automatically stop the sale?

No. A stay or temporary measure should be requested where the law allows.

Is having no other house enough for the suitable-home exemption?

No. The home’s value, family needs and the possibility of purchasing a less valuable suitable home are also considered.

Are attachments removed automatically when the debt is paid?

The full file balance, costs and closure should be completed, after which the enforcement office issues the required removal instructions.
