Why Must a Deportation Decision Be Reviewed Immediately?
A deportation decision may affect a foreign national’s residence, family life, employment, property and ability to re-enter Türkiye. The decision should be served with its reasons and information about legal remedies. The most urgent task is to record the notification date because the judicial challenge period is short.
Foreign nationals consulting an Antalya lawyer or a Serik lawyer should preserve the complete decision, service document, passport, residence or work records and any separate administrative-detention order. A deportation decision and an administrative-detention decision are different acts and may require different courts and petitions.
What Is the Time Limit for Court Action?
The foreign national, legal representative or lawyer may apply to the administrative court within seven days after notification of the deportation decision. The person who files the action should also notify the authority that issued the decision.
The administrative court is required to decide the application within fifteen days, and its decision is final under the special statutory procedure. Because the filing period is a strict short period, waiting for an informal meeting or translation can create serious risk.
Does Filing Suspend Deportation?
Subject to the foreign national’s consent, the person is not deported during the seven-day action period or, if a case is filed, until the judicial review is concluded. Proof that the action was filed should be delivered promptly to the issuing authority and any removal centre.
An incomplete submission, filing in the wrong court or failure to prove the notification date may create disputes. The petition should clearly identify the decision number, issuing governorship and requested interim protection.
Documents to Collect
| Document | Purpose | Important point |
|---|---|---|
| Deportation decision | Shows legal grounds and issuing authority | Every page, attachment and translation should be preserved. |
| Service record | Determines the seven-day period | Record the actual date, interpreter and signature circumstances. |
| Passport and entry-exit records | Shows identity and lawful-stay history | Expired documents and previous passports may also be relevant. |
| Residence or work records | Shows permits, pending applications and lawful status | Include refusals, extension applications and payment receipts. |
| Family and private-life evidence | Shows spouse, children, education, health and social ties | Documents should be current and officially verifiable. |
| Risk evidence | Shows danger in the country of removal | Medical, human-rights and country-specific records should be concrete. |
| Criminal or administrative file | Explains allegations relied on by the authority | Acquittal, non-prosecution or pending-case records may affect assessment. |
Grounds That May Be Challenged
The action may argue that the statutory deportation ground does not exist, the facts were assessed incorrectly, the decision lacks sufficient individual reasoning or deportation would be disproportionate. The applicant may also rely on the statutory situations in which deportation must not be ordered, including serious risk of death penalty, torture or inhuman treatment, unsafe travel because of health or pregnancy, unavailable life-saving treatment and specified victim-protection situations.
A generic statement that the person “has a family in Türkiye” may not be sufficient. Marriage, custody, dependency, school attendance, medical treatment and the consequences for children should be documented.
Public Order and Criminal Allegations
A deportation decision may rely on a criminal conviction, pending investigation or security assessment. The administrative court examines whether the legal ground and individual risk assessment are supported. A criminal case and the deportation case are separate, and the result of one does not always automatically determine the other.
The complete criminal-file status should be obtained. An acquittal, non-prosecution decision, suspension or minor offence may be relevant to proportionality and current risk.
Invitation to Leave Türkiye
Some persons subject to deportation are granted between fifteen and thirty days to leave Türkiye and receive an exit-permit document. Persons considered a flight risk, users of false documents, violators of legal entry or exit rules and persons considered threats to public order, public security or public health may not receive this period.
Leaving voluntarily may affect a future entry ban, but departure should not be arranged without understanding the pending action, travel documents and consequences for re-entry.
Administrative Detention
A person subject to a deportation decision may also be placed in administrative detention at a removal centre. The detention decision is challenged before a criminal judgeship of peace, not through the same administrative-court action used against deportation.
The separate process is explained in how to appeal an administrative detention decision.
Legal Aid and Interpreter Rights
A person who cannot afford legal representation may request legal assistance under the applicable legal-aid framework. The person should be informed about the result, remedy and periods in a language understood. Problems concerning interpretation or failure to provide the complete decision should be recorded.
Entry Bans and Other Consequences
A deportation decision may be accompanied by an entry ban, administrative fine or unpaid removal costs. These acts may have separate legal bases and remedies. Cancellation of deportation does not necessarily remove every entry restriction automatically.
