What Should You Do First After Receiving a Payment Order?
A payment order from a Turkish enforcement office should never be ignored. The first tasks are to identify the legally effective service date and determine which type of enforcement proceeding has been opened. General non-judgment enforcement, negotiable-instrument enforcement, lease-related enforcement and judgment enforcement have different deadlines and application routes.
Debtors consulting an Antalya lawyer or a Serik lawyer should review the payment order together with the envelope or UETS record, enforcement request, contract, invoice, bank records and correspondence. Many periods begin with valid service, so the date shown in an SMS alert or the date the file first appears in UYAP should not be used alone.
How Is the Service Date Checked?
For physical service, examine the envelope, service certificate, delivery address and the person who received it. For electronic service, distinguish the date on which the document reached the UETS address from the date on which it is legally deemed served. If service appears irregular, the delivery method, registered address and actual date of learning should be documented promptly.
Irregular service does not automatically cancel the debt or enforcement file. It may affect the starting date of the period and create a complaint remedy. General service guidance is available in what to do when you receive a legal notification.
What Information Should Be Checked?
| Item | Question | Possible response |
|---|---|---|
| Debtor | Are the name, identity or company details correct? | Identity, representation or wrong-party objection |
| Creditor | Does the claimant have the right to collect? | Assignment, endorsement or standing review |
| Principal | Is the amount due and unpaid? | Full or partial objection, payment evidence |
| Interest | Is the type, rate and starting date correct? | Separate objection to interest and calculation |
| Document | Is the signature genuine and the document legally valid? | Signature objection or negotiable-character complaint |
| Enforcement office | Is the office territorially competent? | Timely jurisdiction objection |
| Service | Was the order served through a lawful method? | Complaint concerning irregular service |
General Attachment Proceedings: The Seven-Day Period
In general non-judgment enforcement, the debtor generally has seven days from service to object to the debt, interest, territorial competence and the signature on an ordinary private document. If no objection is made and no payment is completed, the proceeding may become final.
If the debt is correct, payment should be made using the current file account obtained from the enforcement office. The balance may include principal, interest, fees, statutory attorney fees and enforcement costs. Paying only the amount shown on an old contract or invoice may not close the file.
Why Are Negotiable-Instrument Deadlines Different?
A payment order based on a cheque, promissory note or bill of exchange contains different warnings. Objections to the debt or signature, and complaints concerning the negotiable character, authority or right to proceed, are commonly subject to a short five-day period. The payment period shown in the order is considered separately.
Unlike an objection in the general route, an application in negotiable-instrument enforcement does not automatically stop all enforcement in every case. The enforcement court may be asked for temporary suspension where the statutory conditions are met. See how to collect a promissory note or cheque in Türkiye.
Full and Partial Objection
If the debtor disputes the entire debt, the objection should state this clearly. If only part is disputed, the admitted and disputed portions must be identified precisely. An unclear partial objection may be treated as ineffective for the amount that is not specifically challenged.
Signature and territorial competence should be stated separately where relevant. The correct authority depends on the type of proceeding: some objections are made to the enforcement office, while others must be filed with the enforcement court.
If the Debt Was Already Paid
Prepare bank transfers, receipts, release documents, settlement agreements and correspondence. Check whether the payment covered the same debt, period and invoice. A payment made without a clear description may require additional evidence.
Do not assume that proof of payment automatically removes the file. A timely objection or appropriate court application may still be required.
What Is a Declaration of Assets?
A payment order may warn the debtor about a declaration of assets if the debt is not paid and no objection is made. The declaration concerns assets, income and means sufficient to satisfy the debt. It is not the same as admitting the debt, but failure to comply after the proceeding becomes final may lead to statutory enforcement consequences.
If the Payment Order Was Sent to the Wrong Person
Name similarity, an old company trade name, inheritance, representation or identity error may explain the order. Do not simply discard it. Verify the file and submit the relevant identity, company or succession records within the applicable period.
What Happens If the Proceeding Becomes Final?
The creditor may request attachment of bank accounts, salary, vehicles, immovable property and third-party receivables. Additional interest and costs continue to accrue. Remedies may still exist in exceptional cases, including delayed objection, negative declaratory action or complaint, but they do not provide the same protection as a timely initial response.
Frequently Asked Questions
If I refuse the payment order, does the period not begin?
No. Service may be completed through other methods permitted by law, and the deadline may still run.
Is seeing the file in UYAP the same as service?
Not automatically. The physical or electronic service record and the applicable legal rule must be checked.
Is the seven-day period counted in working days?
It is generally a calendar-day period. The rule concerning a final day that falls on an official holiday is assessed separately.
Can I accept part of the debt and object to the rest?
Yes, but the admitted and disputed amounts must be stated clearly.
Does an objection permanently close the file?
No. In the general route it stops the proceeding, after which the creditor may use a statutory court remedy to continue.
Can instalments be arranged after the order arrives?
Yes, if the creditor agrees or a lawful payment arrangement is made. The treatment of interest, costs, attachments and default should be documented.
Is a lawyer required to respond?
No. However, the authority, form and deadline differ by enforcement type, so incorrect filing may cause loss of rights.
