What Is Administrative Detention for Removal Purposes?
Administrative detention is the placement of a foreign national in a removal centre under a governorship decision while deportation procedures are being carried out. It is not a criminal sentence. The decision may be used for persons considered a flight risk, persons who violate entry or exit rules, users of false documents, persons who fail to leave within the granted period or persons considered a threat to public order, public security or public health.
Foreign nationals and families consulting an Antalya lawyer or a Serik lawyer should obtain both the detention decision and the deportation decision. These are separate administrative acts: detention is challenged before a criminal judgeship of peace, while deportation is challenged before the administrative court.
Who Can Apply to the Criminal Judgeship of Peace?
The detained foreign national, legal representative or lawyer may challenge the detention decision. The petition may be submitted directly to the competent criminal judgeship of peace or delivered to the administration for immediate transmission.
The application does not automatically suspend detention. The petition should therefore explain why continued detention is unnecessary and why one or more alternatives can adequately address the administration’s concerns.
How Quickly Must the Judge Decide?
The criminal judgeship of peace must complete the review within five days. The decision is final under the special statutory procedure. If the facts later change or the legal conditions for detention disappear, a new application may be made.
This ability to reapply is important because health, travel documents, family circumstances, a fixed address or cooperation with the authorities may change after the first decision.
Documents for the Application
| Document | Purpose | Important point |
|---|---|---|
| Administrative-detention decision | Shows the grounds and decision date | Preserve the complete decision and translation. |
| Notification record | Shows whether rights and remedies were explained | Record interpretation and signature circumstances. |
| Passport and identity records | Confirms identity and cooperation | Provide old passports or consular applications where relevant. |
| Fixed-address evidence | Reduces alleged flight risk | Lease, title, accommodation undertaking and address registration may be used. |
| Family records | Shows spouse, children and dependency in Türkiye | Custody, school and health documents strengthen the individual assessment. |
| Health records | Shows vulnerability or need for treatment | Use current hospital reports and medication information. |
| Cooperation evidence | Shows reporting, consular contact and compliance | Explain why less restrictive measures are sufficient. |
What Grounds May Support Release?
The application may argue that the statutory detention ground does not exist, the decision lacks individual reasoning, the person has a stable address and family, there is no realistic flight risk or detention has become disproportionate. Health, pregnancy, disability, age and the best interests of children may also be relevant.
The absence of a passport does not always prove that detention is necessary. Evidence of cooperation with the consulate and efforts to obtain travel documents may support an alternative measure.
How Long Can Administrative Detention Continue?
Detention in a removal centre may not exceed six months. It may be extended for up to an additional six months only where removal cannot be completed because the foreign national fails to cooperate or does not provide correct information or documents concerning the country of origin.
The necessity of continued detention must be reviewed by the governorship every month, and earlier where required. The result should be notified with reasons. A long period does not automatically become lawful merely because removal has not yet occurred.
Alternatives to Detention
The law provides alternatives including residence at a specified address, reporting obligations, family-based return arrangements, return counselling, voluntary public-interest activity, security and electronic monitoring. One or more measures may be imposed, generally for no more than twenty-four months.
The application should propose a practical alternative, identify the address and explain how reporting or security will be complied with. A general request for release without a realistic plan may be less persuasive.
Electronic Monitoring
A person subject to electronic monitoring may challenge that measure before the criminal judgeship of peace. The application does not suspend the monitoring obligation, and the judge decides within five days. The proportionality of monitoring should be assessed according to residence, family and compliance history.
Conditions in the Removal Centre
The detained person should have access to legal representation, health care, communication and information about the decision and remedies. Concerns about medical treatment, interpreter access, family contact or living conditions should be documented and raised through the relevant administrative, judicial or human-rights mechanisms.
Legal Aid
A person who cannot afford a lawyer may request legal assistance under the Legal Profession Act framework. The request should be communicated to the removal-centre administration, bar association or competent authority. The short and ongoing nature of detention review makes prompt access to counsel important.
Relationship with the Deportation Case
Release from administrative detention does not automatically cancel the deportation decision. Similarly, filing a deportation action does not automatically end detention. Both acts should be challenged through their own legal routes.

Can a second application be filed?
Yes, when the conditions for detention disappear or change.
