How to Start Enforcement Proceedings in Türkiye

Last updated: 19 July 2026

What Should Be Checked Before Starting Enforcement Proceedings?

Enforcement proceedings are used to collect a due and unpaid claim through the compulsory enforcement authorities of the state. Before opening a file, the creditor should verify that the claim has become due, identify the debtor correctly, determine the legal basis and amount of the debt, calculate interest and select the appropriate enforcement route. A claim filed against the wrong person, for an incorrect amount or through the wrong procedure may lead to objection, complaint and compensation risks.

Creditors consulting an Antalya lawyer or a Serik lawyer should arrange contracts, invoices, delivery records, bank transfers, formal notices, judgments, cheques or promissory notes in chronological order. An enforcement file should be designed around the legal nature of the claim, not only the assertion that money is owed.

Judgment-Based and Non-Judgment Enforcement

Where the claim is based on a court judgment or another document treated by law as equivalent to a judgment, judgment-based enforcement may be available. For due monetary and security claims without a prior judgment, non-judgment enforcement through the general attachment route may be used. Cheques, promissory notes and bills of exchange may qualify for the special negotiable-instruments procedure with shorter objection periods.

The correct route matters. A non-monetary obligation may not be enforceable through the general attachment procedure. Where a claim is secured by a pledge or mortgage, the general rule requiring the creditor to proceed first against the security, together with statutory exceptions, should be examined.

How Is the Competent Enforcement Office Determined?

In non-judgment enforcement, the enforcement office at the debtor’s residence is commonly competent. The place of contractual performance, a valid jurisdiction agreement and special statutory rules may allow another office. For negotiable instruments, the payment place, issuance place and related connections may be relevant.

The enforcement office may not always examine territorial competence on its own initiative. The debtor may need to raise a timely jurisdiction objection. Opening the file only where the creditor is located is therefore not automatically safe.

What Should the Enforcement Request Contain?

Information What should be stated? Why it matters
Parties Names or trade names, identity or tax data and known addresses Prevents proceedings against the wrong person and supports valid service.
Principal claim Exact unpaid amount and currency Defines the scope of the payment order and later attachment.
Interest Type, rate and starting date Avoids excessive or unsupported interest claims.
Legal basis Contract, invoice, judgment, cheque, note or other source Helps classify the correct enforcement route.
Partial payments Payments already made and remaining balance Prevents duplicate collection and wrongful-enforcement allegations.
Requested route General attachment, judgment enforcement or negotiable-instrument route Determines the form of the order, objection authority and deadlines.

How Is the File Opened?

The enforcement request may be submitted physically to the competent enforcement office. Lawyers can initiate judgment and non-judgment enforcement electronically through the UYAP Lawyer Portal using an electronic or mobile signature. Citizens may monitor files in which they are parties through the UYAP Citizen Portal; available electronic transaction functions depend on the authentication method and current portal permissions.

Initial fees, postal costs and service expenses are paid, and the file receives a reference number. The enforcement office then sends a payment order or enforcement order to the debtor. If service cannot be completed, address research and renewed service may be necessary.

What Happens After the Payment Order Is Served?

In general non-judgment enforcement, the debtor may generally object to the debt, interest, signature or territorial competence within seven days from service of the payment order. A timely objection stops the general proceeding. If the debtor neither objects nor pays, the proceeding may become final and the creditor may request attachment.

For the debtor’s review process, see what to do when you receive a payment order. The objection procedure is explained in how to object to a debt in enforcement proceedings.

What Can the Creditor Do After an Objection?

If the debtor’s objection stops the general proceeding, the creditor may seek removal of the objection before the enforcement court where the statutory documentary conditions exist, or file an action for annulment of the objection before the competent court. The latter examines the existence of the underlying claim through ordinary litigation.

Where the underlying dispute is subject to mandatory mediation, such as an employment, commercial, consumer or lease claim within the statutory scope, pre-litigation mediation should be completed before the action. The applicable remedy and deadline depend on the creditor’s documents and the date on which the objection was notified.

Finalisation, Attachment and Sale

Once the proceeding is final, the creditor may request attachment of the debtor’s bank accounts, vehicles, immovable property, salary, receivables held by third parties or commercial assets. Certain assets and protected income needed for the debtor and family are wholly or partly exempt from attachment.

The right to request attachment and the later request for sale are subject to statutory periods. Required advances must be paid. Opening the enforcement file alone does not preserve every later enforcement step indefinitely.

Common Errors When Starting Enforcement

  • Using an outdated trade name or the wrong debtor
  • Failing to deduct payments already received
  • Claiming the wrong interest type or starting date
  • Filing with an incompetent enforcement office
  • Using the negotiable-instruments route for a document that lacks that legal character
  • Providing an incomplete or misleading service address
  • Assuming attachment occurs automatically before the proceeding becomes final
  • Failing to monitor attachment and sale request periods

Frequently Asked Questions

Is a court judgment required to start enforcement?

No. Due monetary and security claims may be pursued through non-judgment enforcement where the legal conditions are met. An objection may require the creditor to prove the claim before a court.

Is an invoice alone sufficient?

An invoice may support a general enforcement request, but after objection the creditor may also need to prove delivery, agreement and the commercial relationship.

Can enforcement be started if the debtor has no known assets?

Yes. Collection prospects, costs, limitation and possible future assets should still be assessed.

Can enforcement proceedings be started through UYAP?

Lawyers can initiate judgment and non-judgment proceedings through the Lawyer Portal. Citizen functions depend on the authentication method and current portal menus.

Are the debtor’s assets attached immediately after the file is opened?

In the general route, the payment order must first be served and the proceeding must become final. The creditor must then request attachment.

Can the debtor pay the creditor directly after the file begins?

Payment should account for interest, enforcement costs and closure of the file. Paying only the principal directly may leave a balance outstanding in the enforcement file.

Is a lawyer mandatory?

No. However, errors in the route, interest, service, objection and attachment stages may cause substantial loss of rights.
