What Should You Do First After Receiving an Official Legal Notification?
An official legal notification may be sent by a court, enforcement office, prosecutor’s office, administrative authority or another competent body. Service often starts a period for response, objection, payment, appeal, submission of evidence or attendance at a hearing. Ignoring the document or relying only on a short description written on the envelope may lead to serious loss of rights.
People seeking an Antalya lawyer or a Serik lawyer should preserve the document, envelope, attachments and delivery information together on the day it is received. Do not write on the original envelope or discard the delivery record.
Identify the Sending Authority and Type of Document
Check which authority sent the notification, the file number, your role in the file and the action requested. A statement of claim, hearing invitation, expert report, judgment, payment order, administrative fine and enforcement notice have different consequences.
Review the front and back of the document, the envelope and all attachments. If an attachment referred to in the notice is missing, record the problem immediately and inspect the file through the relevant authority. The general court process is explained in what happens after a statement of claim is filed.
Record the Legally Effective Service Date
The date on which you physically read a document may differ from the date on which it is legally deemed served. For physical service, the service certificate, recipient and delivery method should be checked. For electronic service, the UETS records are decisive.
Under the Turkish Notification Law, an electronic notification is deemed served at the end of the fifth day following the date it reaches the recipient’s electronic notification address. Opening the document earlier or failing to open it does not by itself change this statutory rule. UETS accounts and related contact details should therefore be checked regularly.
Legal Notification Review Table
| Review item | Information to check | Action |
|---|---|---|
| Sending authority | Court, enforcement office, prosecutor or administrative body | Identify the legal nature of the document. |
| File details | Case, judgment or enforcement reference number | Verify the file through UYAP or the relevant authority. |
| Service date | Physical delivery record or UETS date | Record the starting date for the legal period separately. |
| Required action | Response, objection, payment, hearing or evidence submission | Calculate the deadline and prepare the required documents. |
| Attachments | Petition, judgment, report or minutes | Check for missing pages and referenced exhibits. |
| Recipient and address | Name, address and procedural role | Note any error or possible irregularity in service. |
Do Not Ignore the Notification
Refusing to accept the document, not opening the electronic message or leaving it unread does not necessarily prevent service. Turkish notification rules allow service to household members, employees, the neighbourhood headman or an electronic address in certain circumstances. A document may therefore be legally effective even if the recipient says that it was not personally read.
If the document appears unrelated to you, verify the identity and file rather than discarding it. Name similarity, an old address, company representation or inheritance may explain why it was sent.
Check the File Through Official Systems
Parties can view information and documents in their court and enforcement files through the UYAP Citizen Portal, subject to the authentication method and access rights available. The file number, authority, parties, procedural history and uploaded documents should be compared with the notice.
SMS or email alerts are only informational. They do not always replace official service and should not be used as the sole basis for calculating a deadline. Use the official document and service record.
If the Document Is a Payment Order
A payment order from an enforcement office may contain a short period for objection and a separate period for payment or declaration of assets. The applicable time depends on the type of enforcement proceeding. A general attachment proceeding, a negotiable-instrument proceeding and a lease-related proceeding do not follow identical rules.
Do not use a standard objection without first identifying the type of order. Further guidance is available in what to do when you receive a payment order.
If the Notification Contains a Court Petition
Read the claims, facts, evidence and requested relief. Check whether all exhibits are attached and whether your name and address are correct. A response petition may have to include procedural objections, substantive defences and evidence within the statutory period.
Waiting until the hearing to respond may result in losing the opportunity to raise certain matters. The response should be prepared based on the complete court file, not only the first page of the notification.
Irregular Service
Service may be irregular if it was sent to the wrong address, delivered to a person who was not legally eligible to receive it, completed without the required record or made through a method not authorised by law. Irregular service does not always mean that the document has no effect at all. The date on which the recipient actually learned of it may become important.
A complaint or procedural objection may be subject to a short period. Preserve the envelope, service certificate, address records and any proof of the actual learning date.
What If You Are Abroad or Away from the Address?
Being abroad, on holiday or temporarily away does not automatically stop legal service. Registered address information, electronic notification obligations, service on representatives and international service rules may apply. Companies and professionals required to use electronic notification should monitor their UETS account even when the responsible employee is absent.
How to Calculate the Deadline
First identify the legally effective service date. Then determine whether the period is expressed in days, weeks, months or years and whether a special law applies. In many procedural periods, the day of service is not counted and calculation begins on the following day, but special rules may differ.
The final day, public holidays, court working hours and electronic submission rules must be checked. A detailed method is provided in how to track legal deadlines.
Protect Yourself Against Fraudulent Messages
Fraudsters may send messages claiming that a lawsuit, enforcement file or fine exists and direct the recipient to an unofficial payment link. Do not pay through a link in an unverified message. Confirm the file through UYAP, e-Government, the named authority or a verified professional.
Official documents contain an authority, file number and procedural information. A demand for immediate transfer to a personal bank account is a serious warning sign.
Frequently Asked Questions
Does refusing the envelope prevent legal service?
No. The notification may be completed through other methods permitted by law, and the legal period may still begin.
Is an SMS from UYAP an official notification?
It is generally an informational alert. The official service document and UETS or physical service records should be used for deadline calculation.
When is an electronic notification deemed served?
It is deemed served at the end of the fifth day following the date it reaches the electronic notification address.
What if an attachment is missing?
Record the missing attachment immediately, inspect the official file and take any necessary procedural step without waiting for the deadline to expire.
Can service to an old address be valid?
It may be, depending on registered address records and the service method. The address history and service certificate must be reviewed.
Does an irregular notification cancel the case?
Not automatically. It may affect the service date and procedural period. The appropriate complaint or objection should be evaluated promptly.
Should I pay an amount requested in a notification immediately?
First verify the authority, file, amount and legal basis. Some documents provide objection rights or separate payment periods.
